  • However, the person interested in renting it pays for the packaging material and transport. Or they can pack goods for transport upon receipt.

  • We take photos of props before handing them over so that we have a mutual overview of the condition in which they are handed over.

  • If the work or any loan object is returned damaged, I will charge the price of the repair based on the hourly rate and flat rate, which includes all other items related to the repair.

  • I offer a system of discounts with regard to the period of borrowing, but there is no legal claim to the discount.

  • By signing the rental contract, the interested party agrees to the possibility of transferring their contact to another person due to changes in reservations (if the interest in the rental crosses between several parties).

1. Basic provision

 

  • These business arrangements regulate the mutual rights and obligations of the Provider and a natural or legal person who uses the Provider's services outside of his business activity as a consumer, or within the framework of his business activity (hereinafter: the "customer"), through partial conditions of contracts concluded between the Provider and the customer.

  • The terms and conditions are an integral part of the contract. Deviating provisions in the contract take precedence over the provisions of these terms and conditions.

  • A contract for the purposes of these GTC means any agreement between the Provider and the customer (hereinafter referred to as the "contract").

2. Pricing information

 

  • If the price of the Provider's products or services is determined by reference to the Provider's price list or the Provider's terms and conditions, the price of such service or product is understood to be the price sent on request in this paragraph (hereinafter referred to as the "price list").

  • If, according to the contract or by law, the customer is obliged to compensate the Provider for damage resulting from the destruction, damage, or other deterioration of the item, he shall pay the Provider the price specified in the price list, if it is specified, otherwise the usual price.

  • Unless otherwise stated in the contract, the price list published at the time of the conclusion of the contract is decisive for contractual performance. In the case of the Provider's claim for damages, the price list published at the time of the damage is decisive.

  • Unless otherwise stated in the contract, the Provider's payment arrangements are as follows and it is paid by cashless transfer or in cash against the Provider's confirmation.

3. Costs and conclusion of the contract
 

  • The costs incurred by the customer when using means of communication at a distance in connection with the conclusion of the contract (costs of Internet connection, costs of telephone calls) are paid by the customer himself. These costs do not differ from the base rate.

  • All information provided on the website is not a proposal to conclude a contract (offer) according to § 1731 of the Civil Code.

4. Shipping costs

 

  • Unless otherwise stated in the contract, shipping and packaging costs are paid by the customer.

  • Unless otherwise stated in writing in the contract, the Provider will deliver its services, or products or other things related to the Provider's services at the Provider's headquarters, or at the Provider's warehouse address, at the Provider's option.

5. Withdrawal from the contract

 

  • A customer who concluded a contract outside of his business activity as a consumer has the right to withdraw from the contract under the following conditions. The provisions of this Article V apply only if the customer is a consumer, otherwise the right to withdraw from the contract is governed by the contract and the Civil Code.

  • The deadline for withdrawing from the contract is 14 days
    — from the date of receipt of goods or services from the Provider,
    — from the date of acceptance of the last delivery of goods or services from the Provider, if the subject of the contract is several linked types of service or delivery of several parts,
    — from the date of acceptance of the first delivery of goods or services from the Provider, if the subject of the contract is regular repeated delivery of goods or services, always within the scope of such delivery.

  • The customer cannot, among other things, withdraw from the contract:
    — about the provision of services, if they were provided in full; in the case of performance for consideration, only if it began with the prior express consent of the consumer before the expiry of the period for withdrawing from the contract and the entrepreneur informed the consumer before concluding the contract that the right to withdraw from the contract expires by providing the performance,
    — on the delivery of goods manufactured according to the consumer's requirements or adapted to his personal needs,
    — on urgent repair or maintenance to be carried out at the place designated by the consumer at his express request; however, this does not apply to the performance of other than requested repairs or the delivery of goods other than spare parts necessary for repair or maintenance,
    — on the transport of goods, the rental of a means of transport according to the contract fulfilled on a certain date or in a certain period,
    — in other cases specified in § 1837 of the Civil Code,
    — in other legal cases.

  • In order to comply with the withdrawal period, the customer must send a withdrawal statement within the withdrawal period.

  • The customer shall send the withdrawal from the contract to the e-mail or delivery address of the Provider specified in these terms and conditions. The provider will immediately confirm receipt of the document to the customer.

  • The customer who has withdrawn from the contract is obliged to return the services delivered by the Provider related to the Project within 14 days of the withdrawal from the contract by the Provider. The Customer shall bear the costs associated with returning the service related to the Project to the Provider, even if the service related to the Project cannot be returned due to its nature by the usual postal route.

  • If the customer validly withdraws from the contract, the Provider shall return to him without delay, but no later than 14 days from the withdrawal from the contract, all funds, including delivery costs, received from him in the same manner. The provider will return the received funds to the customer in another way only if the customer agrees and if no additional costs are incurred.

  • If the customer has chosen a method other than the cheapest method of delivery of goods or services offered by the Provider, the Provider will refund to the customer the cost of delivery of goods or services in the amount corresponding to the cheapest method of delivery of the service offered.

  • If the buyer withdraws from the purchase contract, the seller is not obliged to return the received funds to the buyer until the seller receives the goods or until the buyer proves to him that he has sent the goods back, whichever occurs first.

  • Any delivered goods must be returned by the customer to the Provider undamaged, unworn and unpolluted and, if possible, in the original packaging.

  • A model form for withdrawing from the contract is attached to these terms and conditions, or freely available according to Government Regulation No. 363/2013 Coll., as amended.

6. Práva z vadného plnění
 

  • Zákazník, který uzavřel smlouvu mimo svoji podnikatelskou činnost jako spotřebitel, má v tomto čl. VI uvedená práva z vadného plnění. Ustanovení tohoto čl. VI. se uplatní, pouze pokud je zákazník spotřebitelem, v opačném případě se práva z vadného plnění řídí smlouvou a občanským zákoníkem.

  • Poskytovatel odpovídá zákazníkovi, že služby nebo vady dodané Poskytovatelem při převzetí nemají vady. Zejména Poskytovatel odpovídá zákazníkovi, že v době, kdy zákazník služby související s Projektem převzal:
    — mají služby související s Projektem vlastnosti, které si strany ujednaly, a chybí-li ujednání, má takové vlastnosti, které Poskytovatel popsal nebo které zákazník očekával s ohledem na povahu služby související s Projektem a na základě reklamy Poskytovatelem prováděné,
    — se služby související s Projektem hodí k účelu, který pro jeho použití Poskytovatel uvádí nebo ke kterému se služby související s Projektem tohoto druhu obvykle používá.

  • Povinnosti z vadného plnění má Poskytovatel nejméně v takovém rozsahu, v jakém trvají povinnosti z vadného plnění dodavatele Poskytovatele.

  • Zárukou za jakost se Poskytovatel zavazuje, že služby a zboží bude po určitou dobu způsobilé k použití pro obvyklý účel nebo že si zachová obvyklé vlastnosti. Vytkl-li zákazník Poskytovateli vadu služby nebo zboží oprávněně, neběží lhůta pro uplatnění práv z vadného plnění ani záruční doba po dobu, po kterou nemůže zákazník vadné služby nebo zboží užívat.

  • V případě výskytu vady může zákazník Poskytovatelem předložit reklamaci a požadovat:
    — opravu zboží nebo služby,
    — přiměřenou slevu,
    — odstoupit od smlouvy.

  • Práva z odpovědnosti za vady zboží nebo služby uplatňuje zákazník, popř. za něj osoba jím písemně zmocněná bez zbytečného odkladu po výskytu vady, a to s tím, že od výskytu vady nesmí být služba nebo zboží související s projektem dále užíváno. Při uplatnění reklamace je nutné zvolit způsob nápravy, který si zákazník zvolil. 

  • Je-li zákazníkem spotřebitel, rozhodne Poskytovatel o reklamaci ihned, ve složitých případech do 30 pracovních dnů. Do této lhůty se nezapočítává doba přiměřená podle druhu služby potřebná k odbornému posouzení vady. Reklamaci včetně odstranění vady vyřídí poskytovatel nejpozději do 30 dnů ode dne uplatnění reklamace, pokud se se zákazníkem nedohodne na delší lhůtě. Marné uplynutí této lhůty se považuje za podstatné porušení smlouvy. Je-li zákazníkem podnikatel, vyřídí Poskytovatel reklamaci v přiměřené lhůtě.

  • Zákazník má právo odstoupit od smlouvy, pokud má služba nebo zboží podstatnou vadu.

  • Podstatné je takové porušení smlouvy, o němž strana porušující smlouvu již při uzavření smlouvy věděla nebo musela vědět, že by druhá strana smlouvu neuzavřela, pokud by toto porušení předvídala.

  • U vady, která znamená nepodstatné porušení smlouvy (bez ohledu na to, jde-li o vadu odstranitelnou či neodstranitelnou), má zákazník nárok na odstranění vady anebo přiměřenou slevu.

  • Právo z vadného plnění zákazníkovi nenáleží, pokud zákazník před převzetím věci věděl, že věc má vadu, anebo pokud zákazník vadu sám způsobil.

  • Práva a povinnosti smluvních stran ohledně práv z vadného plnění se řídí § 1914 až 1925, § 2099 až 2117 a § 2161 až 2174 občanského zákoníku a zákonem č. 634/1992 Sb., o ochraně spotřebitele.

 

7. Delivery

 

  • The contracting parties may deliver all written correspondence to each other via electronic mail.

  • The Customer delivers the Provider's correspondence to the e-mail address specified in these terms and conditions. The provider delivers correspondence to the customer to the e-mail address specified in the contract.

 

8. Personal data

 

  • All information provided by the Customer to the Provider is confidential and will be treated as such. If the customer does not give written permission, the Provider will not use the customer's data in any other way than for the purpose of fulfilling the contract.

9. Out-of-court settlement of disputes

  • The European Consumer Center Czech Republic, with registered office at Štěpánská 567/15, 120 00 Prague 2, internet address: www.evropskyspotrebitel.cz is the contact point according to Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 of May 2013 on online consumer dispute resolution and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC (Regulation on online consumer dispute resolution).

  • The provider is authorized to offer selected goods and services on the basis of a trade license. The trade inspection is carried out by the relevant trade office within its jurisdiction. Among other things, the Czech Trade Inspection supervises compliance with Act No. 634/1992 Coll., on consumer protection, within a defined scope.

10. Final Provisions

 

  • All arrangements between the Provider and the customer are subject to the legal system of the Czech Republic. If the relationship established by the contract contains an international element, then the parties agree that the relationship is governed by the law of the Czech Republic. This does not affect consumer rights arising from generally binding legal regulations.

  • In relation to the customer, the provider is not bound by any codes of conduct within the meaning of § 1826 paragraph 1 letter e) of the Civil Code.

  • All rights to the Provider's website, in particular copyright to the content, including page layout, photos, films, graphics, trademarks, logos and other content and elements, belong to the Provider. It is forbidden to copy, modify or otherwise use the website or part of it without the consent of the Provider.

  • The provider is not responsible for errors arising as a result of interventions by third parties in the website or as a result of its use contrary to its purpose. When using the website, the customer must not use procedures that could have a negative effect on its operation and must not perform any activity that could allow him or third parties to interfere or use the software or other components that make up the online store and use the online store or its parts or software equipment in such a way that would be contrary to its purpose or purpose.

  • The customer hereby assumes the risk of a change in circumstances within the meaning of § 1765, paragraph 2 of the Civil Code.

  • The purchase contract, including the terms and conditions, is archived by the Provider and is not accessible.

  • The customer acknowledges that the software of the website and some data published on the website are copyrighted works and are thus protected by the relevant provisions of Act. No. 121/2000 Coll., of the Copyright Act, as amended. The customer is fully responsible for any infringement of these copyrights.

  • The wording of the terms and conditions may be changed or supplemented by the Provider. This provision does not affect the rights and obligations arising during the effective period of the previous version of the terms and conditions.

These terms and conditions take effect on 15. 05. 2023.
